Terms of Service – Student Meals

Welcome to Student Meals (“we”, “us”, “our”). We operate StudentMeals.com.au and related services to provide fresh, pre-prepared meals to students and customers in Melbourne and surrounding areas.

By accessing our website, placing an order, or using our services (the “Services”), you agree to be bound by these Terms of Service and our Privacy Policy [LINK]. If you do not agree, you must not use the Services.


1. Eligibility & Account Responsibility

  • You must be at least 18 years old or have parental/guardian consent to place an order.

  • You agree to provide accurate, current, and complete information when creating an account or placing an order.

  • You are responsible for keeping your account credentials secure and for all activity on your account.


2. Our Products

  • We take care to ensure our product descriptions are accurate. However, actual appearance, packaging, and portion sizes may vary due to seasonal ingredients or supplier changes.

  • All meals are perishable goods and must be stored according to our instructions.

  • Nutritional information and allergen advice are provided in good faith but may contain traces of allergens due to kitchen processes.


3. Orders & Acceptance

  • Placing an order constitutes an offer to purchase. Orders are only accepted when we send you a confirmation email after payment is processed.

  • We may decline or cancel orders due to stock shortages, delivery restrictions, or other operational reasons.

  • Once confirmed, orders for perishable goods cannot be cancelled unless required under the Australian Consumer Law (e.g., if the product is faulty).


4. Pricing & Payment

  • Prices are in Australian dollars (AUD) and inclusive of GST unless stated otherwise.

  • Prices may change without notice. The price at checkout is final unless a clear error is identified.

  • You agree to provide valid and authorised payment details.


5. Shipping, Delivery & Risk

  • Delivery times are estimates only. While we aim to meet scheduled delivery windows, delays can occur due to factors outside our control.

  • Risk and responsibility for your order pass to you upon delivery to the address provided or as per your safe drop-off instructions.


6. Incorrect Addresses & Missed Deliveries

  • It is your responsibility to ensure the delivery address is correct and accessible.

  • If the address provided is incorrect, incomplete, or inaccessible, we cannot guarantee replacement or refund.

  • If you are not available at delivery and no safe drop-off instructions are provided, your order may be left in a location deemed reasonable by the driver. We are not liable for spoilage, theft, or damage once the order is delivered.

  • If you request unattended delivery (“Authority to Leave”), our responsibility ends once the order is left at the agreed location.


7. Refunds & Replacements – Perishable Goods

In line with Australian Consumer Law, you are entitled to a replacement, store credit, or refund if your meal:

  • Is unsafe to consume.

  • Is significantly different from what was described.

  • Arrives damaged in a way that makes it unsafe to eat.

Claims process:

  • Contact us within 24 hours of delivery.

  • Provide your order number, description of the issue, and photos of the product and packaging.

  • We may offer a replacement meal, store credit, or refund depending on the situation.

We do not provide refunds or replacements for:

  • Change of mind.

  • Orders not promptly refrigerated after delivery.

  • Issues caused by incorrect addresses or missed deliveries as outlined in Section 6.


8. Intellectual Property

All text, images, graphics, recipes, branding, and other content on our website are our intellectual property and may not be copied, reproduced, or used without our written consent.


9. Third-Party Links & Services

Our site may contain links to third-party websites or tools. We are not responsible for the content, services, or actions of third parties. Use them at your own risk.


10. Prohibited Conduct

You must not:

  • Use our Services for unlawful purposes.

  • Interfere with website security or performance.

  • Misuse our intellectual property.

  • Provide false information in an order or account.


11. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for indirect or consequential losses.

  • Our total liability for any claim is limited to the amount paid for the affected order.

  • Nothing in these Terms limits your rights under the Australian Consumer Law.


12. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes will be handled in the courts of Victoria.


13. Changes to These Terms

We may update these Terms from time to time. The latest version will be posted on our website with the effective date. Your continued use of the Services constitutes acceptance of the updated Terms.
